San Jose Medical Marijuana Dispensary Ordered To Move



SAN JOSE (KCBS) -- The San Jose Cannabis Buyers Collective is being forced to relocate from its office across from the Valley Fair Mall after receiving a cease and desist order from the city.
The collective was one of seven pot clubs ordered to relocate or close its doors because of complaints from neighbors, said a code enforcement official, Mike Hannon.
“They’re just simply not permitted,” he said. The complaints that motivated the cease and desist orders ranged from parking and traffic issues to noise or land use issues.
Moving the pot clubs away from residential areas creates a hardship for the 3,000 patients served by the city’s first dispensary, complained a spokeswoman for the Cannabis Buyers Collective, Erika Taylor Montgomery.
“Patients who live within a several mile radius of this location are now going to have to travel much farther to get their medicine. That’s been a problem all along in the city,” she told KCBS reporter Mike Colgan.
Montgomery said patients sometimes travel to Santa Cruz, Oakland or San Francisco for their pot, “which is very difficult for patients who are ill.”
City officials estimate there are 20 to 30 other medical marijuana dispensaries operating in San Jose. Hannon urged those clubs to close while the city council debated passing an ordinance to regulate medical marijuana dispensaries.
Several Bay Area cities have declared moratoriums or outright bans on pot clubs.
