5 AM. Cops knock on the door...

This is my personal experience, just a couple hours ago..

Roommate wakes me up at 5am, he says the cops are here.
At first I thought he was playing a sick joke, but it wasn't.
apparently, a neighbor heard arguing and decided to call the really bored pig force.
I got one plant with pipes and bongs all about in my room.. so i turn off my exhaust cause it's a lil noisy and close my door as i go see whats going on.
(cops wanted to see everyone in the apartment to "make sure they're ok")
so me my roommate and his girlfriend were standing there saying, yeah we're ok, and they say they 'need' to look inside the apartment to make sure there's no one else around that's hurt, and they can't take our word for it.
well we've all heard stories about people letting the cops in on good faith that they don't care about any drugs they just wanna see that everyone's ok...
Lucky me, i got a kick *** roommate that already wouldn't let them in with out a warrant. they asked me and I said that I see no reason for them to come in, and everything's all well and good.
they tried to insist and persist. but they couldn't blow this house down!
we know our rights. they threatened to get a search warrant and we called their bluff! they left threatening we'd all get arrested if they get called back for any 'disturbance'. I'm not skurd.
at one point, when the cop was asking why he couldn't just come in and check around my buddy said, "cause your a duck." , and the guy was like, "what was that?" then my buddy said, "huh?", then guy was like, "i didn't hear what you just said.", and my buddy said, "ok."
maybe you had to be there, but it was funny.
so the cops left and all is well and good after a few bowls and beers.

Well play Ishnish. Never give them permition to LEO to do anything. Make them give you a warrent, and ask for your laywer to be present when it is excuted.

plus, it being 5 in the morning, they'd be waiting 3 hours to get a judge that was awake to sign a warrant!
their exact words were, "we don't care about any dope or porn, we're just looking for bodies."
... well, no warrant, no lookie lookie! punk leo even kept his foot in the door after we said not to come in.. maybe i should file a complaint... lol..

Holly :holysheep: . That a close one man ....and your roomate is a smart person that can handle stuff fast , very trusted too i bet . Never let's leo in the property no matter what is always the right thing to do . And what a nosy neightboor yall have man , a little arguement and call the cops at 5am like that . Well i guess depend on what town or city you live in , cuz where i am party and yelling at 2-3am in the morning on the street or on my house portio the cops and neighbor never care . There's a fine line between needing a warrant and being able to kick the door in.

There are times when the pigs can kick in a door with no warrant.

IF they hear something themselves that sounds like a person in stress, they can and often do, force entry. This is legal as hell and in fact saves many people a year from further harm than has already been done to them in domestic assault involving the calling of and arrival of the pigs.

There is a time and place. The key to the non-warrant entry is "Immediate threat or harm". If the pigs have some sort of evidence that they can provide the DA later, that induced them into believing harm has been done to a person or a persons life is in immediate peril, or if they see something like a blood pool seeping from under a door, they can force entry if necessary to prevent the furtherance of more harm.

They better be able to back that up later. YOUR lawyer will make them, and they know it.

Watch out for smart mouthing cops. They will lie, cheat and plant evidence to make their forced entry legal in the DA's eyes.

Piss them off enough and they'll "find" that little bag of cocaine that "was visible from the outside of the doorway and near the child". Anyone who thinks Pigs don't plant evidence is naive.

Pissing them off enough to humiliate them is just what it takes to become a victim of pig force.

Any lawyer will tell you the same thing the late Patrick Swayze said in "Roadhouse", "Be polite. Do what is necessary, but Be Polite".

Insist on your rights. If they can get a search warrant, then they will, but be polite when you tell them that is what they will need if they intend on entering your residence. Just do so politely with lots of "Sirs and Ma'am's".

Kicking at a rattlesnake is NOT a good way to get rid of one.

Thanks guys. I think most know what I think of the pigs. I can't stand to even be in the same room with one, but pissing one off on purpose is crazy. It's like crapping in your own hat. Sooner or later you gotta put it back on...

the file a complaint thing was a joke
leo was saying, "you seem like the most reasonable person here..." blah blah blah, trying to sweet talk me into giving permission.. but i just sat down on the floor and pet the dog while smoke'n a cig... waiting to see a 'warrant'.
I'm sure to be looking for a new place in the very near future though.
main thing that had me worried wasn't my plant, but the sandwich bags in the kitchen and weed + digi in my room.. i've heard many horror stories...
and yeah, they had absolutely no reason to think anyone could be in harm other than someone calling and saying they heard fighting, which i wonder what time they called it in, cause at 5am, everyone here had been asleep for a couple hours at least... poor response time for leo... i think if someone had been in danger, it woulda been too late by the time they showed up..

domestic violence calls cops don't take as a joke bros...there is a charge called "verbal domestic violence" couple of grand fine there and not up to the couple state takes over...one of my nieghbors got it. and she even was on his side and not what your thinking...she was dumbfounded "i can't yell at my husband?!?!?!" Just a heads up like....
