Well, I had a great meeting with my Lawyer yesterday.

I am ready(almost), to put my butt on the line and do this thing above the radar and legal as legal can be.

In the State of California, according to a memorandum relesed by Our State Attorney General, it is no longer legal to claim Caregiver status on multiple indviduals. This was a loophole used by many folks to justify large grow ops.
BUT, it is legal to start a "collective" and grow for multiple folks under the "collective" banner.

What does that mean??

It means that I can grow for individuals who join my collective.
Any excess herb can be sold to compensate costs and time to other Medical patients or dispensaries.

blah blah blah.

Basically, I would buy a wearhouse. It has to be a secured,locked facility with limited access to only individuals that are part of the collective.

Here is my plan. My lawyer agreed and said this was the best plan he had heard of yet.

For every patient that joins my collective, I would grow thier weed for them. I would supply the area,the lights,pay for all the equipment and ALL associated costs of the grow. The patient would have NO out of pocket exspense.
So, "Jimmy" wants to join. Jimmy has a Reccomendation of 50 plants.
I fire up 5-1000w lights and 5 4x4 tables with 10 plants in each tray.
At the end of the Harvest, Jimmy gets half and I get half. Jimmy is estatic, cause jimmy gets a big bag of herb that cost him NOTHING to grow.
I get the other half. This will be sold to compenstae for the costs of the grow and all other expenses. Of course, I will also get compensated for my time,efforts and knowledge.

It's a win win for everyone involved.

Now, I know alot of you are thinking, why don't Jimmy just grow his own and keep it all. Well, Jimmy has never grown and has NO interest in growing. Jimmy doesnt want a grow op at his house with his kids running around. Jimmy is also tired of buying herb on the street. Plus, Jimmy has a BLACK thumb and has killed all his wifes plants at one time or another.
There are MANY reasons why folks do not grow thier own.


So, I have been thinking of this for a LONG time. After Tuesday, I have a little hope that the Federal raids in California will soon come to an end.
I am just doing a little pre-work to see if State Law wise, my plan was within the guidelines, which it was. But we all know Federally, we have no leg to stand on.

So, for now, this is where my plan lies. If there is a directive from the Feds to not engage in raids in MMJ allowed states, I am ready and my plan is in place.

I have been an underground grower since 89'. I am tired of hiding.
 
This is only the first step in MANY. As I said, this was just a meeting with a Lawyer to discuss the legalities in such an operation from the state law point of view.

If Fed law does not change, I am in the same boat. I give it a 50/50 chance, I just want to be prepared just in case.

The larger you get, as in more remote operations you deal with...along with keeping open lines of communication things can get really crazy really fast.

BUT...

We are able to provide ourselves and many other patients, provinding strains that actually have viable, valuble medical applications.

This, of course, is all dependent on the Feds and if they get called off.
Otherwise, I, and many others like me, will contiinue they we have been, under the radar.

I look forward to being open abut it.

Effen, I want to get away from the smaller remote ops and go Big in one location. I know it is legal right now in our state, but I am still fearful of FEDLEO, thus is why I stay underground, for the most part. Smaller ops, less plant #s, just more locations. I want one main area. I'm talking about 2000 sq/ft at least. Close to home, not in the Bay.

Just getting my ducks in a row, feeling it out. It is INGRAINED in me to stay stealth and lowkey. It was a big step, for me, to even seak out true legal advise on this matter.
The only thing that has stopped me before is the fact that FEDLEO is lurking, medical or not. But I have hope that will soon change.

And like u said Effen...It's about to go down Big Time........

There are many others that will go HUGE if that call is made to end Fed prosecution of MMJ patients. I don't think folks truly understand what will happen when it does. It will be the Nations number one new Industry.
 
norcal good luck to you. until weed is rescheduled and legalized at the federal level i would still stay under the radar, dont trust lawyers or anyone else. i dont think you gain anything by trying to do it legit because there are always people that dont like marijuana, and people that want to steal your marijuana.

Go ahead with your plan, but have a cover story, and if possible, keep the location to yourself. i agree with going big in one place rather than mutiple locations -ya its a full time job to run the entire operation but the less people that know about it the greater chance of success. when looking for a warehouse, choose one that has huge electrical capacity - like 200-600 amps, and make sure you have a "legit" reason for using all that power. im assuming you dont have $25000 to buy a diesel generator...

commercial marijuana growers must be professionally paranoid as in: no electronic communication, making sure your not followed to/from grow room/being watched, etc. helluv work but its the most fun fulfilling job in the world

just makes u realise how crap it is in the UK, our government is re-classifying to class B from class C, and telling everyone its because of lethal new skunk!!!

And you guys are talking about setting up warehouse grows!!!!!

Hal congrads. This reminds me of the youtube video when Tommy Chong meets the browndirtwarrior. He tells him" Things are gonna change". There may be legislation that will require the clubs to be non-profit soon. You are a pioneer, expect problems and go with the flow.
 
Hering stuff like this really makes me so anxious to get out of college with this law degree already where i can really get voices heard, and i really do use this site as a HUGE motivation for me in my schooling.

Why on earth would you need that many unless you were crossing like 20 strains at the same time?

We grow BIG indoor plants, normally in isolated DWC containers (Home Depot Strongboxes) or just plain coco if we are feeling lazy.

Our harvests are bountiful. No need for the insane numbers. Makes you look like a cartel to the govt.

Hey NorCal- First of all- don't get mad at me and use that cow killing thing on me :p - that guy in your avi was one scary s.o.b.

You said that you could be compensated for time, effort, and knowledge. So now you got tax issues. What about liability- someone having a bad reaction or some other problem- whether caused by your product or not- they'll come after your op. What governmental agency would be responsible for monitoring your processes to ensure the public health?

So you give Jimmy product for free- but another MMJ user has to pay? Why wouldn't all MMJ users join a collective?

Something of this magnitude would surely attract alot of bureaucrats on many levels looking for their piece of the pie- on all levels. Unfortunately, I don't think Tuesday helped us that much. Regardless of our opinions here, MJ will need to continue to be a controlled substance- and all will want to have their due.

I sincerely hope that you can bring this to fruition. If indeed you do, I offer my services free of charge- I'll sweep the floor or carry water for you, whatever you need.

I appreciate all your concerns, and believe me when I say tey are also my concerns.

I havn't raised my head out of the sand yet....

The only conversation I have had about this is with my Lawyer, and the folks here at MP.

BBFan, you have some great points. Alot of which u speak has allready been covered by exsisting MMJ Dispensaries, BUT they are still at risk Federally.

I will not come "above" ground unless The feds get called off of MMJ States. There is no way I would risk Federal Time.
As I said, I am just getting ducks in a row in hope of a federal Law change.
As far as taxes and all the permits that go with it, they are all available to me.
Also BB, There are already HUNDREDS of such operations currently going on in the State. Some are open about it, most are not. I want to be open about it, when the time comes.

Why do I think it will work? Simply, alot of folks would rather not grow thier own, plain and simple. We, as growers, are truly the minority of pot smokers.
There are far more folks who would rather get thier smoke from someone they can trust. I would also be very caereful of who is allowed in the 'colective". I personally have enough friends to keep me busy for the rest of my life.
Will it happen? I am hopeful.

So, please don't get me wrong, I have not bought 50 lights (yet! lol) and blown things up. Just finally doing a littlw legal homework.

I'm an optimist, I have hope the feds will get called off of our state in regards to MMJ patients. When this happens, the state will turn all green, trust me. I just want to be one of the first.
