SC lawyers say cops making arrests in Phelps case

This is downright ignorant!!!!!!

COLUMBIA, S.C. (AP) — Police in the South Carolina county where Michael Phelps was photographed smoking from a marijuana pipe have been arresting people as they seek to make a case against the superstar swimmer, lawyers for two arrested people said Thursday.

Attorneys Joseph McCulloch and **** Harpootlian told The Associated Press they each represent a client charged with possession of marijuana who were questioned about the party Phelps attended near the University of South Carolina campus in November.
The lawyers said the two clients were renters at the house where the party apparently took place, although they were not at the party. The two have since moved and were arrested after police executed a search warrant at their new home and accused them of having a small amount of marijuana there.

"After they arrested him, they didn't ask him, 'Where did you get the marijuana?' or 'Who sold it to you?' Almost all the questions they asked him were about Michael Phelps," Harpootlian said.

The lawyers would not name their clients, who each face up to 30 days in jail and a $200 fine if convicted on the pending charges.

The Richland County Sheriff's Office would not comment on the lawyers' remarks.
"As soon as we're ready to release information on this case we will and we're still in the middle of this investigation," said Lt. Chris Cowan.

After the photo was published Feb. 1, Sheriff Leon Lott said his office would investigate and possibly charge Phelps, though officials have not specified what the offense might be.

Phelps, 23, and his representatives have not disputed the photo's accuracy. Phelps has issued a public apology, acknowledging "regrettable" behavior and "bad judgment" after the photo appeared. USA Swimming has suspended Phelps for three months and the Kellogg Co. has cut ties with him, although other sponsors are sticking with the swimmer.

The lawyers said their clients were not at the party. McCulloch, who said his client was out of town at the time, doubted that anything they told police would assist them in the case against Phelps.

"Our clients answered questions but I don't know that their information would be helpful to law enforcement," McCulloch said. "It seems to me that Richland County has a host of its own crime problems much more serious than a kid featured in a photograph with a bong in his hand."

On a "Good Morning America" broadcast Thursday, McCulloch characterized the arrests as "a fascination, if not an effort, to destroy a public hero."

Lott has said Phelps should not get a break because of his fame. Harpootlian told The Associated Press that he believes police are being overzealous.

"I find it amazing the justification is they don't want to treat him any differently just because he is a celebrity, and he is being treated far differently than any other Joe Blow who might have smoked marijuana four or five months ago."

Under South Carolina law, possession of one ounce or less of marijuana is a misdemeanor that carries a fine up to $200 and 30 days in jail for the first offense. Possession of drug paraphernalia is a $500 fine.

Columbia television station WIS-TV was first to report earlier this week that eight arrests related to the party had been made, but did not name a source. McCulloch said college students and lawyers have told him that about eight arrests have been made.
Lott has made fighting drug crimes a central plank of his career. He rose from patrol officer to captain of the narcotics division in the early 1990s. He was first elected sheriff in 1996 and has held the post since.

Could you even clearly see it was marijuana in the bong? I mean we know it was, but is there evidence beyond a reasonable doubt that it was for sure marijuana.

Standing up for Michael Phelps, who has been forced to issue a public apology after a picture of him smoking marijuana hit the web over the weekend, Ashton Kutcher wrote Twitter message on Monday, February 2, giving the swimmer some support. "I wish the media would kill this Phelps story," so the actor wrote his defense for the record-breaking Olympian swimmer.

"God forbid he hit a bong. Go ask your 20 year old kid what they did last weekend," he wrote further. "I'm not saying it was a smart move. But he doesn't need to be publicly outed for it. Who ever put the pic out is an a**!"

"He's a good kid. Btw he could be a real douche but he's not. Maybe the media can quit dragging his d*** in the dirt," Ashton added. "I don't smoke and haven't in quite some time. But I'm not immune to a lapse in good judgement (sic) from time to time."

They are putting Phelps though the ringer and he didn't even lie to congress, like many major league players did. This just ticks "The Man" off because it disproves much of the brain washing he has been dishing out for the last 50+ years.
 
I think they are realizing the weed war is lost and are grasping for any little straws they can find... Wouldn't it be a riot after all if Phelps stated publically that he was glad Kelloggs dropped him because their cereal SUCKS!? And because they use clever advertisements to trick niave little children into eating their garbage while contributing greatly to the higher incidences of diabetes and obesity and any serious athlete wouldn't eat it anyway? Even if it weren't true, it would still be funny...
 
I dont know any grown men or women who dont have kids and dont smoke weed that eat cereal so....
Plus what if all us stoners started boycotting all these companies who seem to have a problem with us. shoot i only eat cereal when i'm high.
 
What funny is Phelps will go to Jail for having a Bong up to his face, and the Peanut comp. will get sued for wrongful death or which ever. so where the Law over this peanut ****, and why Didn't those people goes to JAIL.
Oh that RIGHT IT IS LEGAL to send Contaminated peanut butter out to the Public and get Sued.. No Jail Time for them Peanut corp people..
 
You know whats funny... we in a recession and money is still being wasted on the pettiest stuff. I dont care who smokes weed. I dont care who does steroids. What I do care about is where our tax dollars go. To me it is not that serious. Dude is only human. Shoot there are judges with DUI's, ex vice presidents that have killed,and senators buying sex. I care more about these people than anything. I dont hold athletes to as high a standard as public officials. I mean dang they get paid for recreational things. I dont know all of this is crazy.
 
LE can be some real pricks in the South. this sounds like the kind of of town where the man that shook the hand of the man that shook the hand of Jonny Carson is a star. They get to catch Big Mike. Hell, they will will probably pose with him in his mugshot.

BTW- As a person that got kicked out of small commune (town doesn't do it justice) in Alabama (DCreeper was there:hubba:) I know what i speak about.
 
Olympic pot smoker Michael Phelps is my hero. I wished he could’ve had the balls to stand up against the media when he was caught chocking on a bong at the South Carolina college party. Don’t they understand, he was simply performing CPR on the bong, after it fell into the swimming pool! Ha! Ha! So sad that Kellogg’s dropped his commercials, but it’s actually more harmful for the body to consume Kellogg’s Pop Tarts or a bowl of Kellogg’s Fruit Loops, then taking one hit from a bong! Ha! Ha! LOL

It's been my experience that the $200 fine is nothing compared to the other fees and expenses assesed. Typically the 30 days jail time would be a minimum probation of a year so the defendants out of pocket into the system money would include a defense lawyers fee along with monthly probation fees - community service time of at least 40 hrs and some counties charge for the pee tests they can hit you on every month if they want.... they probably also get federal grant money comperable to all the drug busts they do - regardless of the size so the police, the lawyers, the PO dept, a lab, free labor for some community department in the form of community service - they all get a piece of the pie.
